Laura victims get a break on tax deadlines

Victims of Hurricane Laura, including those in St. Mary and St. Martin, now have until Dec. 31, 2020, to file various individual and business tax returns and make tax payments, the Internal Revenue Service announced this week.
 Following the recent disaster declaration for individual assistance issued by the Federal Emergency Management Agency, the IRS announced today that affected taxpayers in certain areas will receive tax relief.
Individuals and households who reside or have a business in Acadia, Allen, Beauregard, Bienville, Bossier, Caddo, Calcasieu, Cameron, Catahoula, Claiborne, Evangeline, Grant, Jackson, Jefferson Davis, Lafayette, La Salle, Lincoln, Morehouse, Natchitoches, Ouachita, Pointe Coupee, Rapides, Sabine, St. Landry, St. Martin, St. Mary, Union, Vermilion, Vernon, Webster, West Feliciana, and Winn parishes qualify for tax relief. Taxpayers in localities added later to the disaster area will automatically receive the same filing and payment relief.
The declaration permits the IRS to postpone certain tax-filing and tax-payment deadlines for taxpayers who reside or have a business in the disaster area. For instance, certain deadlines falling on or after Aug. 22, 2020, and before Dec. 31, 2020, are postponed through Dec. 31, 2020, This includes individual and business tax filers that had a valid extension to file their 2019 return due to run out on Oct. 15, 2020. The IRS noted, however, that because tax payments related to these 2019 returns were due on July 15, 2020, those payments are not eligible for this relief. 
 The Dec. 31 deadline applies to the third quarter estimated tax payment due on Sept. 15. It also applies to the quarterly payroll and excise tax returns normally due on Nov. 2. In addition, it applies to tax-exempt organizations, operating on a calendar-year basis, that had a valid extension due to run out on Nov. 15. In addition, penalties on deposits due on or after Aug. 22, 2020, and before Sept. 8, 2020, will be abated as long as the tax deposits were made by Sept. 8, 2020.
 If an affected taxpayer receives a late filing or late payment penalty notice from the IRS that has an original or extended filing, payment or deposit due date that falls within the postponement period, the taxpayer should call the telephone number on the notice to have the IRS abate the penalty.  The IRS automatically identifies taxpayers located in the covered disaster area and applies filing and payment relief. But affected taxpayers who reside or have a business located outside the covered disaster area should call the IRS disaster hotline at 866-562-5227 to request this tax relief.

The localities listed above constitute a covered disaster area for purposes of Treas. Reg. §301.7508A-1(d)(2) and are entitled to the relief detailed below.
Affected Taxpayers
Taxpayers considered to be affected taxpayers eligible for the postponement of time to file returns, pay taxes and perform other time-sensitive acts are those taxpayers listed in Treas. Reg. § 301.7508A-1(d)(1), and include individuals who live, and businesses (including tax-exempt organizations) whose principal place of business is located, in the covered disaster area. Taxpayers not in the covered disaster area, but whose records necessary to meet a deadline listed in Treas. Reg. § 301.7508A-1(c) are in the covered disaster area, are also entitled to relief. In addition, all relief workers affiliated with a recognized government or philanthropic organization assisting in the relief activities in the covered disaster area and any individual visiting the covered disaster area who was killed or injured as a result of the disaster are entitled to relief.
 Under section 7508A, the IRS gives affected taxpayers until Dec. 31, 2020, to file most tax returns (including individual, corporate, and estate and trust income tax returns; partnership returns, S corporation returns, and trust returns; estate, gift, and generation-skipping transfer tax returns; annual information returns of tax-exempt organizations; and employment and certain excise tax returns), that have either an original or extended due date occurring or after Aug. 22, 2020, and before Dec. 31, 2020.
Affected taxpayers that have an estimated income tax payment originally due on or after Aug. 22, 2020, and before Dec. 31, 2020, are postponed through Dec. 31, 2020, will not be subject to penalties for failure to pay estimated tax installments as long as such payments are paid on or before Dec. 31, 2020.
 The IRS also gives affected taxpayers until Dec. 31, 2020 to perform other time-sensitive actions described in Treas. Reg. § 301.7508A-1(c)(1) and Rev. Proc. 2018-58, 2018-50 IRB 990 (Dec. 10, 2018), that are due to be performed on or after Aug. 22, 2020, and before Dec. 31, 2020, are postponed through Dec. 31, 2020.
 This relief also includes the filing of Form 5500 series returns that were required to be filed on or after Aug. 22, 2020, and before Dec. 31, 2020, are postponed through Dec. 31, 2020, in the manner described in section 8 of Rev. Proc. 2018-58. The relief described in section 17 of Rev. Proc. 2018-58, pertaining to like-kind exchanges of property, also applies to certain taxpayers who are not otherwise affected taxpayers and may include acts required to be performed before or after the period above.
 Unless an act is specifically listed in Rev. Proc. 2018-58, the postponement of time to file and pay does not apply to information returns in the W-2, 1094, 1095, 1097, 1098 or 1099 series; to Forms 1042-S, 3921, 3922 or 8027; or to employment and excise tax deposits. However, penalties on deposits due on or after Aug. 22, 2020, and before September 8, 2020, will be abated as long as the tax deposits were made by Sept. 8, 2020.
Casualty losses
Affected taxpayers in a federally declared disaster area have the option of claiming disaster-related casualty losses on their federal income tax return for either the year in which the event occurred, or the prior year. See Publication 547 for details.
 Individuals may deduct personal property losses that are not covered by insurance or other reimbursements. For details, see Form 4684, Casualties and Thefts and its Instructions.
 Affected taxpayers claiming the disaster loss on a 2019 or 2020 return should put the Disaster Designation, “Louisiana - Hurricane Laura,” in bold letters at the top of the form. Be sure to include the disaster declaration number, FEMA 4559, on any return. See Publication 547 for details.
 Other relief
The IRS will waive the usual fees and requests for copies of previously filed tax returns for affected taxpayers. Taxpayers should put the assigned Disaster Designation “Louisiana - Hurricane Laura,” in bold letters at the top of Form 4506, Request for Copy of Tax Return, or Form 4506-T, Request for Transcript of Tax Return, as appropriate, and submit it to the IRS.
 Affected taxpayers who are contacted by the IRS on a collection or examination matter should explain how the disaster impacts them so that the IRS can provide appropriate consideration to their case. Taxpayers may download forms and publications from the official IRS website, IRS.gov.

STEVE JOHNSON

Steve Johnson, 67, a native of Marksville and resident of Morgan City, died Tuesday, Oct. 6, 2020, at Ochsner St. Mary.
Visitation will be Saturday from 11 a.m. until services at 1 p.m. at Jones Funeral Home in Morgan City. Face masks and social distancing required. Services can be viewed on funeral home Facebook page. Burial will follow in Morgan City Cemetery.
He is survived by his wife, Mary Johnson of Morgan City; four children, Tracey Johnson, Keisha Page and Darnell Johnson, all of Lafayette, and Yolonda Evans of Bunkie; three stepchildren, Precious Matthews of Morgan City, Gentry Dugas of Sunset and Byron Dugas of Lafayette; four siblings, Ronnie Johnson of Virginia, and Mark Johnson, Mary Johnson and Ellen Johnson, all of Marksville; 22 grandchildren; one great-grandchild; and a host of other relatives.
He was preceded in death by his father, mother and three sisters.
Jones Funeral Home is in charge of arrangements.

Alternating lanes on new bridge Sunday

Alternating lane closures on the E.J. “Lionel” Grizzaffi U.S. 90 Bridge and the Long-Allen La. 182 Bridge will take place Sunday to allow crews to remove debris from the bridges’ shoulders, the state Department of Transportation and Development announced in a press release.
From 6 a.m. to 5 p.m., weather permitting, the U.S. 90 bridge will have alternating eastbound and westbound lane closures.
From 6 a.m. to noon, weather permitting, the La. 182 bridge will have alternating closures of the eastbound and westbound lanes.
All permit and oversize loads along with emergency vehicles will be allowed to pass. There are no detours.
DOTD reminds motorists to drive with caution through the construction site and be on the lookout for work crews and their equipment.

Trick-or-treating hours set locally

Trick-or-treating hours recently were announced across St. Mary Parish for Saturday night.
According to the St. Mary Parish Sheriff’s Office’s Facebook page, the parish’s unincorporated areas and Morgan City, Patterson, Berwick, Franklin and Baldwin all will observe trick-or-treating from 6 p.m. until 8 p.m. Franklin’s Boo on the Bayou also will be held from 6 p.m. until 8 p.m.
Trick-or-treaters, as well as those distributing candy, should social distance, wear masks, wash hands and sanitize candy as much as possible.

Deadline for requesting absentee ballot is Friday

Secretary of State Kyle Ardoin is reminding voters of the upcoming absentee ballot deadlines.

The deadline to request an absentee ballot is Friday, Oct. 30 at 4:30 p.m. Requests can be made online by visiting voterportal.sos.la.gov and selecting "Request Absentee Ballot,” or in person at the parish registrar of voters office.

Voters who have requested but not yet received an absentee ballot may check their absentee ballot status by visiting voterportal.sos.la.gov, entering the appropriate voter information and selecting "Check Absentee Ballot Status."

The deadline to return a completed ballot is Monday, Nov. 2 at 4:30 p.m.

Should a voter be unable to meet an absentee ballot deadline, they can still vote in-person on Election Day. Polling locations can also be found on voterportal.sos.la.gov or on the free GeauxVote mobile app.

Twin brothers charged in St. Martin homicide

Twin brothers face murder charges in the Oct. 18 shooting death of a St. Martin Parish teen, according to St. Martinville Police Chief Ricky Martin.
—Damontae Gardner, 20, St. Martinville, was arrested Wednesday on charges of second-degree murder, aggravated assault and criminal damage to property.

—Davontae Gardner, 20, St. Martinville, was arrested Wednesday on charges of second-degree murder, aggravated assault and criminal damage to property.

Officers responded to a complaint of shots fired in the 200 block of Honore Street at around 11:30 p.m. Oct. 18. Brandon Kerlegan was found shot several times and was pro-nounced dead at the scene, according to Martin. A second victim, Bernard Mitchell IV, was grazed in the arm.

St. Martin Parish Sheriff Becket Breaux also reported these arrests:

—Charles, Marvin, 22, Valsin Street, Breaux Breaux, was arrested Tuesday on a charge of possession of Schedule II narcotics, prohibited acts and distribution of drug paraphernalia.

—Davis, Jarmal, 32, Tina Street, Breaux Bridge, was arrested Monday on a charge of violation of a protective order.

—Perrodin, Daniel, 41, George Touchet, Breaux Bridge, was arrested Monday on a charge of violation of protective order.

St. Mary Parish Sheriff Blaise Smith reported these arrests

—Juvenile male, 16, Baldwin, at 10:12 a.m. Tuesday on a charge of simple assault. The boy was released into the custody of a guardian pending juvenile court proceedings.
—Mandy Henry, 35, Dalton Drive, New Iberia, was arrested at 12:47 p.m. Tuesday on an active New Iberia Parish warrant for telephone calls-harassment. Henry was released on a summons to appear in New Iberia Nov. 30.

—Javion R. Taylor, 19, 1 James Street, Morgan City, was arrested at 2:53 p.m. Tuesday on a charge of pos-session of marijuana. Taylor was released on a summons to appear Jan. 7.

Morgan City Police Chief James F. Blair reported these arrests:

—Thomas St. Germain, 28, Marshall Street, Morgan City, was arrested at 10:10 a.m. Tuesday on a charge of simple battery.

Officers were called after a complaint of a battery. Officers learned that after a verbal dispute, St. Germain struck one of the subjects involved in the dispute. St. Germain was placed under arrest and transported to the Morgan City Police Department for booking.

—Henry Swiber III, 46, Louisa Street, Morgan City, was at 12:29 a.m. Tuesday on a charge of hit and run driving.

Swiber was arrested after being located on warrants held by MCPD. The warrants stemmed from an accident Oct. 17. Swiber was placed under arrest and transported to the Morgan City Police Department.

—Kelly Verdun, 49, Bayou Vista, was arrested at 5:11 p.m. Tuesday on a Morgan City Court warrant for failure to appear in connection with a charge of contempt of court.

Verdun was arrested at MCPD on a warrant from City Court of Morgan City on a Contempt of Court warrant. Ver-dun was booked into the Morgan City Police Department jail.

—Scott Treadway, 56, Naquin Street, Baldwin, was arrested at 6:22 p.m. Tuesday on charges of criminal tres-passing, disturbing the peace-intoxicated, possession of alcoholic beverages in a motor vehicle.

Assumption Parish Sheriff Leland Falcon reported these arrests
—Shandrika L. Scott, 30, Blackwell Lane, Belle Rose, was arrested Monday on a charge of domestic abuse-aggravated assault.
Deputies responded to a request from Acadian Ambulance at the Belle Rose address in reference to a domestic incident with medical needs.

Deputies made contact with Scott as well as the victim. An investigation revealed that the two parties had been involved in a relationship that deteriorated over the past couple of weeks.

There were circumstances which brought the two together at the location of this incident and resulted in a con-frontation. That incident resulted in the victim being cut in the face by Scott.

Scott was arrested and booked into the Assumption Parish Detention Facility and remains incarcerated pending a bond hearing.

On Oct. 18, deputies commenced an investigation and identified two juvenile suspects.

On Oct. 20, a 15-year-old was charged by verified complaint and was released to the custody of his parents. The verified complaint encompassed seven vehicle burglaries.

On Monday, another 15-year-old was charged by verified complaint with seven vehicle burglaries. That sus-pect is in continued custody in a juvenile facility pending appropriate proceedings.

Russo garners honors

Kirsten “KiKi” Russo, daughter of Jon Russo and Franklin native Melanie Baker Russo, was voted Best Visual Artist 2020 by The Daily Advertiser, Times of Acadiana Best of 2020 in September.
When pressed, she describes her style of art as: Surrealist-Pop and “whimsical.”
Self-taught, she has been making visual art for six years now, and said she began drawing after she was forced at the age of 16 to stop playing her violin, on which she was classically trained, due to nerve damage in her arm. She was also a singer, but said she needed more of a creative outlet. That “more” became her passion for visual art.
“I decided to buy some paint, and give it a go to see if I could paint… and I was pretty ok, so I kept trying, and over time, honed my skills,” Russo said.
Among her influences, she named Van Gogh, Salvador Dali, Lora Zombie and Bob Ross.
She said she usually sets up in downtown Lafayette for the Lafayette Artwalk, the second Saturday of every month, but with the advent of COVID and the restrictions that have come along with it, she has, like the rest of Acadiana, been at home instead.
She said she has not been able to work recently due to a broken wrist sustained in a skating accident, but she expects to be back in prime function by January.

Halloween!

Well, the Halloween season is in full swing in St. Mary Parish, despite necessary pandemic-related accommodations. Yet, the spooky spirit of this time of year prevails in the parish, even if carefully.
St. Mary Parish Library, in cooperation with the Trowbridge House in Franklin, recorded a video on Oct. 21 of three witches reading spooky stories for Halloween. The video is available at SMPL’s Facebook page.
The city of Franklin will be holding its annual “Boo on the Bayou” Halloween celebration on Oct. 31, from 6 to 8 p.m., during the city’s official trick-or-treat hours.
As in years past, folks are asked to line up on Main Street, turning left onto Willow Street, and following the line down Teche Drive, past Parc Sur La Teche, then left onto Adams Street, where the event will terminate at Main Street.
The attending public is asked to consider thesevarious Covid-19 mitigation measures:
1. Physical distancing of those NOT within the same household to be monitored and enforced;
2. The wearing of a face covering of the nose and mouth will be required to enter and/or serve treats throughout the entire route;
3. All vendors/community members distributing treats will be physically distanced by 6 ft. along Teche Drive;
4. The line will be a one way line of service which includes one entrance and one exit all strictly monitored to ensure physical distancing;
5. Partnership with Franklin Foundation Hospital and Teche Action Clinic to have volunteer providers and/or healthcare staff as “Boo” monitors and liaisons to ensure a safe, healthy environment for all in attendance;
6. Hand Sanitizer will be provided at the entrance and throughout the route.
The City is requesting all interested community organizations, businesses, schools, churches, community members that want to distribute candy to all “trunk or treaters” in attendance. Shooting leads to arrest

Baldwin Assistant Police Chief Samuel Wise III reported that Sandra LeBlanc of Baldwin was killed last week, shot by her husband.
According to Wise, on Oct. 21, at approximately 12:48 p.m., the Baldwin Police Department responded to a call in reference to a female subject that had been shot by her husband.
Angela LeBlanc informed authorities that while going check on her mother, who was not answering the telephone, she had noticed her father, Sonny LeBlanc Sr., riding a bicycle in only his underwear on the 200 block of Main Street. LeBlanc Sr. stated to his daughter that he had shot his wife, Sandra LeBlanc at 101 Newman Street, Baldwin.
LeBlanc Sr. was located the same day near Dixon Funeral Home on Main Street, Baldwin, and was taken into custody by authorities.
He was arrested on the charge of second degree murder.
Wise further reported that upon officers’ arrival, Sandra LeBlanc was found to have been shot in the chest.
