The St. Mary Parish Council met on this date in Regular Session with Chairperson Gwendolyn L. Hidalgo presiding and the following members present: Craig A. Mathews, J Ina, Rodney Olander, Leslie “Les” Rulf, Jr., James W. Bennett, Jr., Mark A. Du- hon, Dean S. Adams, and Kristi Prejeant Rink, M.D. Absent were Scott Ramsey and Patrick J. Hebert.
The Invocation was pronounced by Mr. Bennett and the Pledge of Allegiance was led by Mr. Duhon.
Mr. Olander moved that the reading of the Second Regular Meeting, September 27, 2023, be dispensed with and that the same be approved. Mr. Ina seconded the motion, which carried.
Emma Clement, Chloe Paridon 4-H Representatives, and 4-H Students to appear before the Council to request adoption of a Proclamation declaring October 1 – 7, 2023 as National 4-H Week in St. Mary Parish. (Proclamation to be adopted)
Dr. Rink moved that the following Proclamation be adopted. The Council seconded the motion, which carried by the following 9-0-0-2 Roll Call vote:

PROCLAMATION
2023 NATIONAL 4 - H WEEK
WHEREAS, The St. Mary Parish Council is proud to honor the 4-H Youth Development Program of the LSU AgCenter for more than 100 years of providing experience-based education to youngsters throughout the state; and
WHEREAS, this admirable program, which seeks to provide a learning experience for the whole child, including head, heart, hands, and health, helps young Louisianans to acquire knowledge, develop life skills, and form attitudes to enable them to become self-directed, productive, and contributing members of our society; and
WHEREAS, its 250,000 urban, suburban, and rural youth participants, ranging in age from eight to nineteen, hail from diverse ethnic and socioeconomic backgrounds and truly represent a cross-section of the state; and
WHEREAS, the program undoubtedly could not have achieved the success that it has today were it not for the service of its more than 7,000 volunteers, who have given generously of their time, talents, energies, and resources to the youth of Louisiana; and
WHEREAS, throughout its proud history, the 4-H program has developed positive role models for countless Louisianans and through its innovative and inspiring programs, continues to build character and to instill the values that have made our state strong and great.
NOW, THEREFORE, BE IT RESOLVED, that the St. Mary Parish Council, hereby designates October 1 – 7, 2023, as National 4-H Week in St. Mary Parish, Louisiana and commends the 4-H Youth Development Program of the Louisiana Extension Service and the many men and women who have made the program a success.

Franklin Merchant Association President, Diane Wiltz appeared before the Council to discuss the “Harvest Moon Festival” to be held on Saturday, October 28, 2023, with kickoff beginning Thursday, October 26, 2023 from 6:00 - 8:00 p.m.
Craig Rink ap- peared before the Council to discuss the Bayou Horseshoe Pitchers Association Pro Tour Tournament beginning October 20-22, 2023 with an open ceremony to be held on October 21, 2023 at 9:00 a.m.
Delta Sigma Theta Sorority, Inc. Chapter President, Alexis Rack appeared before the Council to announce open house for the F-J Delta Building to be held on October 23, 2023 at 6:00 p.m., 106 Teche Drive, Franklin. She requested that the cooperative endeavor agreement for occupancy of the building be extended to five (5) years instead of the current annual agreement.
After discussion, Mr. Ina requested that Section 2 of the agreement be revised to reflect five (5) years and that it be placed for approval on the next agenda.
In response to Dr. Rink’s inquiry relative to any other agreement modification re- quest, Ms. Rack stated that the elevator needs repair.
Chief Administrative Officer, Jean Paul Bourg stated that this is an exterior elevator that was previously used for handicap accessibility or to deliver supplies and that it should not be used regularly. He stated that he will have maintenance inspect it.
Ms. Rack also informed that the “Stop the Violence Program” will be held on October 21, 2023 at 10:00 a.m. at West St. Mary High/BEB Middle School Gymnasium.
Josh Manning, South Central Planning and Development Commission appeared before the Council to discuss reapportionment maps/redistricting and he apologized for not attending the last meeting. He informed that he submitted a de- tailed spreadsheet of changes and the amended ordinance that moves the boundary line back to where it is supposed to be to Clerk of the Council, Lisa Morgan.
Per Mr. Adams’ inquiry, Mr. Manning stated that he can provide a current map to the Council and the public to review. He also stated that the At Large District lines were moved in error due to the delay of receiving the census and no 2010 Census map from the previous demo- grapher.
Per Lisa Morgan’s inquiry, Mr. Manning stated that he is available to attend the next Council meeting with the amended maps.
In response to Mr. Olander’s in- quiry, Mr. Manning stated that the amended maps also show precincts.
Registrar of Voter, Terry Foulcard and Deputy Registrar, Raquel Baker appeared before the Council to update on Redistricting and Reapportionment.
Per Mr. Olan-der’s inquiry, Mrs. Foulcard stated that the Verdunville area precincts are correct for this election.
In response to Dr. Rink’s inquiry, Mrs. Foulcard stated that she had reviewed the amended ordinance but had not seen the amended maps. Mr. Adams requested that Mrs. Foulcard be given a copy of the amended maps.
Parish President David Hanagriff reminded that October 14, 2023 is election day and encouraged everyone to vote.
Chief Administrative Officer, Jean Paul Bourg, submitted his re- port for a two (2) week period ending October 11, 2023.
Mr. Ina thanked Mr. Bourg for the sign installation at the Willie J. Peters Fire Sub-Station in St. Joseph.
Per Mr. Adams’ inquiry relative to the increase in tipping fees for municipalities, Mr. Bourg and President Hanagriff stated that the municipalities are given a 30 day notice.
In response to several Council Members’ inquiries relative to grass cutting and digging ditches in Hedgerow Subdivision, Siracusaville, Amelia, Centerville, and Verdunville, Mr. Bourg stated that these areas are on schedule for maintenance.
Per Dr. Rink’s inquiry relative to the decrease in the Debt Service Tipping Fee, Finance Director, Paul Governale stated that one (1) bond is being paid off next year.
Dr. Rink reported on the Consolidated Gravity Drainage District 2A meeting that she attended on October 10, 2023 relative to the pump replacement at Pump Station No. 9.
Lisa Morgan informed that Item 13D, “Resolution providing for the approval and authorization for Change Order No. 1 relative to the Concrete Roadway Improvements to Duhon Boulevard project,” was a clerical error that should have read for the “Substantial Completion” of the project. She explained that the agenda needs to be expanded to adopt the resolution.
Mr. Olander moved that the following Resolutions be adopted. Rev. Mathews seconded the motion, which carried by the following 9-0-0-2 Roll Call vote:

RESOLUTION
Resolution auth- orizing and ap- proving the Parish President to execute an Agreement with the State of Louisiana, Department of Transportation and Development relative to State Project No. H.015725 – Segmented Circle Rehabilitation at Harry P. Williams Airport in Patterson, Louisiana.
WHEREAS, Act 451 of the 1989 Regular Session of the Louisiana Legislature authorized the financing of certain airport improvements from funds appropriated from the Transportation Trust Fund; and
WHEREAS, the St. Mary Parish Government has requested funding assistance from the LA DOTD to/for Segmented Circle Rehabilitation; and
WHEREAS, the stated project has been approved by the Louisiana Legislature and the LA DOTD is agreeable to the implementation of this project and desires to cooperate with the St. Mary Parish Government according to the terms and conditions identified in the attached Agreement; and
WHEREAS, the LA DOTD will provide the necessary funding for the Segmented Circle Rehabilitation and reimburse the sponsor up to $14,904.00 of project cost.
NOW, THEREFORE, BE IT RESOLVED, by the St. Mary Parish Government that it does hereby authorize the President to execute an Agreement for the project identified as AIP No. 3-22-0044-026-2023 and SPN H.015725, more fully identified in the Agreement attached hereto, and to execute any subsequent related documents, including, but not limited to, amendments to said agreement.

RESOLUTION
A resolution to establish the cost per ton for the disposal of solid waste delivered and accepted by the Parish of St. Mary, in accordance with the Solid Waste Disposal Agreement between the St. Mary Parish Council, the Cities of Morgan City, Franklin and Patterson and the Towns of Baldwin, and Berwick, Louisiana.
BE IT RESOLV-ED, that in accordance with Paragraph (a) of Section VI of the Solid Waste Disposal Agreement enter-ed into by the St. Mary Parish Council, and the Cities of Morgan City, Franklin and Patterson and the Towns of Baldwin and Berwick, Louisiana, and recorded in Book 20-G of Conveyances, Entry No. 196,347, the cost per ton of solid waste delivered to and accepted by the Parish of St. Mary at the Harold J. “Babe” Landry Solid Waste Reduction and Resource Re- covery Facility and the West End Pick Up Station shall be $57.00.
BE IT RESOLV-ED, that in accordance with the Order issued by the Louisiana Department of En- vironmental Quality authorizing the Commencement of Operations of the Construction and Demolition Debris Landfill at the Harold J. “Babe” Landry Landfill the cost per ton for disposal of Construction and Demolition Debris delivered to and accepted by the Parish of St. Mary shall be $52.00.
BE IT FURTHER RESOLV-ED, that in accordance with the Permit issued by the Louisiana De- partment of Environmental Quality for Standard Solid Waste Type I at the Harold J. “Babe” Landry Landfill the cost per ton for disposal of Industrial Waste delivered to and accepted by the Parish of St. Mary shall be $73.50.
NOW, THEREFORE, BE IT FURTHER RE- SOLVED, that these cost per ton shall be effective November 13, 2023.

RESOLUTION
A Resolution providing for the approval and authorization for Change Order No. 1 relative to the Concrete Roadway Improvements to Duhon Boulevard project.
WHEREAS, a certain contract has been entered into between the St. Mary Parish Council and Byron E. Talbot Contractor, Inc., P.O. Box 5658, Thibodaux, Louisiana 70302, relative to the Concrete Roadway Improvements to Duhon Boulevard project, and
WHEREAS, the items as shown on Change Order No. 1 will result in an increase of $536.49 in the contract price.
NOW, THEREFORE, BE IT RESOLVED, that the St. Mary Parish Council does hereby approve the issuance of Change Order No. 1 covering an increase of $536.49 in the contract price for the Concrete Roadway Improvements to Duhon Boulevard project.
BE IT FURTHER RESOLV-ED, that the President of St. Mary Parish, David Hanagriff, be and he is hereby authorized to execute Change Order No. 1 on behalf of the St. Mary Parish Council.

RESOLUTION
A resolution re- questing funding from the State of Louisiana, under the provisions of the 2024-2025 Capital Outlay Act on behalf of the Parish of St. Mary for Infrastructure Improvements and Construction of a Welding Training Facility at Charenton Canal Industrial Park Capital Outlay Project No. 572436
WHEREAS, the Parish of St. Mary is in need of Infrastructure Improvements at Charenton Canal Industrial Park consisting of construction of a welder training facility and road construction at the facility for St. Mary Parish Government, and;
WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.
NOW, THEREFORE, BE IT RESOLVED, by the St. Mary Parish Council of the Parish of St. Mary, Louisiana, acting as governing authority for the said Parish, herein petition the State of Louisiana to provide 2024-2025 Capital Outlay funding to match local funds for In- frastructure Im- provements and Construction of a Welding Training Facility at Charenton Canal Industrial Park.

A resolution requesting funding from the State of Louisiana, under the provisions of the 2024-2025 Capital Outlay Act on behalf of the Parish of St. Mary for Reconstruction of Martin Luther King Street in Charenton from LA. Hwy. 326 to Creek Drive within existing right-of-way Capital Outlay Project No. 572437
WHEREAS, the Parish of St. Mary is in need of reconstruction of Martin Luther King Street in Charenton from LA. Hwy. 326 to Creek Drive, a distance of approximately 3,000 LF. The road is in serious deteriorating condition with major potholes and large sections crumbling caused by daily traffic of patrons visiting the nearby Cypress Bayou Casino and;
WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.
NOW, THEREFORE, BE IT RESOLVED, by the St. Mary Parish Council of the Parish of St. Mary, Louisiana, acting as governing authority for the said Parish, herein petition the State of Louisiana to provide 2024-2025 Capital Outlay funding to match local funds for Reconstruction of Martin Luther King Street in Charenton from LA. RESOLUTION
A resolution requesting funding from the State of Louisiana, under the provisions of the 2024-2025 Capital Outlay Act on behalf of the Parish of St. Mary for Installation of Emergency Power Improvements at the St. Mary Parish Courthouse Capital Outlay Project No. 572438
WHEREAS, during hurricane emergencies the Parish of St. Mary is in need of Emergency Power to maintain operations at the St. Mary Parish Courthouse for St. Mary Parish Government, and;
WHEREAS, during hurricane emergencies and similar events, it is necessary for personnel and officials of the St. Mary Parish Government and the St. Mary Parish Sheriff, whose offices are on the fifth and fourth floors of the Parish Courthouse respectfully, must be fully operational during the duration of the emergency; and at the present time there is no emergency power system for the air conditioning and electrical systems on those floors; and there is a need to install an emergency generator system to provide emergency power to enable air conditioning and electrical systems to be operational for those two floors, and other associated areas within the Courthouse, and;
WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.
NOW, THEREFORE, BE IT RESOLVED, by the St. Mary Parish Council of the Parish of St. Mary, Louisiana, acting as governing authority for the said Parish, herein petition the State of Louisiana to provide 2024-2025 Capital Outlay funding to match local funds for Installation of Emergency Power Improvements at the St. Mary Parish Courthouse.

WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.

A resolution requesting funding from the State of Louisiana, under the provisions of the 2024-2025 Capital Outlay Act on behalf of the Parish of St. Mary for Roof Replacement at Fairview Treatment Center, Bayou Vista, LA. Capital Outlay Project No. 572440
WHEREAS, Fairview Treatment Center in Bayou Vista, LA. is a repurposed previously closed two story hospital, now used for substance abuse rehabilitation that is in need of a roof replacement for its residential wing, and;
WHEREAS, the facility, having previously served as a hospital, is in sound condition but is experiencing short and long-term aging issues with the need for roof replacement, interior modification, and ADA and functional upgrade of the elevator system, and;
WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.
NOW, THEREFORE, BE IT RESOLVED, by the St. Mary Parish Council of the Parish of St. Mary, Louisiana, acting as governing authority for the said Parish, herein petition the State of Louisiana to provide 2024-2025 Capital Outlay funding to match local funds for Roof Replacement at Fairview Treatment Center in Bayou Vista, LA.

The reconstruction of the roadway which serves heavy traffic from an industrial area will be within existing rights-of -way, and;
WHEREAS, the Parish does not have the necessary funds in the capital projects budget to provide the funding for said project and there are no existing special assessments, loans, or bond issues available to the Parish for such encumbrance, and;
WHEREAS, the current budget of the Parish does not have allowance for non-recurring appropriations, and;
WHEREAS, the current collection of revenues is at a projected level for the current operating budget and no surplus funds are anticipated in the near term.

Per Dr. Rink’s inquiry relative to the members’ compensation, Mr. Olander stated that Recreation District No. 7 receives funds from the 3/10% Sales Tax Fund for maintenance and compensation. Mr. Olander stated that residents are not in favor of a millage.
B. As per LA RS 38:291 (Z) relative to the St. Mary Levee District, the St. Mary Parish Council is responsible for submitting a list containing three nominations from each of the eight single member parish council districts. The Governor shall appoint one member to represent each District.

NO. 2345
An Ordinance of the St. Mary Parish Council condemning the im- provements consisting of the Plantation Inn Hotel, situated at 815 Highway 90, Parcel ID No. 298428104500-2984281004.00, as a result of same being in a dilapidated and dangerous condition which endangers the public welfare and ordering the demolition and removal of said improvements by the owner thereof in not less than sixty days from the effective date of this Ordinance.
SECTION I.
WHEREAS, Louisiana law, and in particular LSA-R.S. 33:4761 et seq. authorizes the governing authority of any Parish to condemn and cause to be demolished or removed any building or structure within the Parish when it is in a dilapidated and dangerous condition which endangers the public welfare;
WHEREAS, there has been submitted to the Parish a written report recommending the demolition and removal of certain structures, consisting of the Plantation Inn Hotel, situated at 815 Highway 90, Parcel ID No. 298428104500-2984281004.00, as a result of same being in a dilapidated and dangerous condition which endangers the public welfare;
WHEREAS, the Parish President has heretofore served upon the owner of the structures a notice requiring the own-er to show cause at a meeting of this council why the structures should not be condemned, which notice provided the owner with the notice of the St. Mary Parish Council meeting to be held on October 11, 2023, at 6:00 p.m.;
WHEREAS, after hearing the evidence presented at the aforementioned Parish Council meeting, the Parish Council has determined that the structures in question are in fact in a dilapidated and dangerous condition which endangers the public welfare;
WHEREAS, it is the decision of this Council that the structures in question be condemned as a result of same being in a dilapidated and dangerous condition which endangers the public welfare.
SECTION II.
NOW, THEREFORE, BE IT ORDAINED by the St. Mary Parish Council, acting as the governing authority of the Parish of St. Mary, State of Louisiana that:
A. The improvements consisting of the Plantation Inn Hotel, situated at 815 Highway 90, Parcel ID No. 298428104500-2984281004.00 are hereby condemned as a result of the finding of this Council that same are in a dilapidated and dangerous condition which endangers the public welfare.
B. Eastin Properties, LLC, the owner of said property, is hereby ordered to demolish and remove said improvements not less than sixty (60) days from the effective date of this Ordinance.
C. In default of the owner complying with the order to demolish and remove the im- provements, the Parish President may proceed with the demolition or removal of the condemned structures after giving notice to the owner and/or owner’s agent and/or the attorney at law appointed to represent the owner giving the time when the work will begin upon the demolition and removal of the structures.
D. In the event the Parish does perform the demolition and removal of the structures, or engages a third party or third parties to perform such demolition and removal, the Parish President is directed to file a lien and privilege upon the immovable and its im- provements pursuant to the provisions of LSA-R.S. 33:4766.
SECTION III.
This Ordinance shall become effective upon adoption.
SECTION IV.
All Ordinances or parts of Ordinances in conflict herewith are hereby repealed.
SECTION V.
Should any provisions of this Ordinance be declared in violation of state law, the remaining portions shall remain in full force and effect.
This ordinance having been offer-ed and read on this the 27th day of September 2023; having been published in accordance with law; and having been heard in a public hearing at Franklin, Louisiana on the 25th day of October 2023; was adopted by the following vote on the 25th day of October 2023.
