The St. Mary Parish Council met on this date in Regular Session with Chairperson Gwendolyn L. Hidalgo presiding and the following members present Rev. Craig Mathews, J Ina, Rodney Olander, David W. Hill, Patrick Hebert, James “Jimmy” Davis, Jr., Mark Duhon, Dean Adams, and Kristi Prejeant Rink, M.D. Absent was Leslie “Les” Rulf, Jr.
The Invocation was pronounced by Mr. Davis and the Pledge of Allegiance was led by Mr. Duhon.
Mr. Olander moved that the reading of the Second Regular Meeting minutes, April 24, 2024, be dispensed with and that the same be approved. Mr. He- bert seconded the motion, which carried.
Beverly Domen-geaux, Executive Director, St. Mary Council on Aging appeared before the Council to discuss the “Older Americans Month” Proclamation.
Mr. Adams re- quested to move up Item 15A, “Proclamation proclaiming the month of May 2024 as Older Americans Month.”
Mr. Adams mov-ed that the following Proclamation be adopted. The Council seconded the motion, which carried by the following 10-0-0-1 Roll Call vote:

PROCLAMATION
WHEREAS, May is Older Americans Month, a time for us to recognize and honor St. Mary Council on aging older adults and their immense influence on every facet of American society; and
WHEREAS, through their wealth of life experience and wisdom, older adults guide our younger generations and carry forward abundant cultural and historical knowledge; and
WHEREAS, older Americans improve our communities through intergenerational relationships, community service, civic engagement, and many other activities; and
WHEREAS, communities benefit when people of all ages, abilities and backgrounds have the opportunity to participate and live independently; and
WHEREAS, St. Mary Council on Aging must ensure that older Americans have the re- sources and support needed to stay involved in their communities – re- flecting our commitment to inclusivity and connectedness; and
NOW, THEREFORE, BE IT RE- SOLVED, that the St. Mary Parish Council, hereby proclaim the month of May 2024, as:
OLDER AMERICANS MONTH
This year’s theme, “Powered by Connection,” emphasizes the profound impact of meaningful interactions and social connection on the well-being and health of older adults in our community. We call upon all residents to join us in recognizing the contributions of older citizens and promoting programs and activities that foster connection, inclusion, and support for older adults.

Allison McGuinness, Outreach Representative for Louisiana’s Attorney General Liz Murrill, and the Louisiana Department of Justice appeared before the Council to in- troduce herself and to inform of services that they offer.
EXECUTIVE SESSION
Go into Executive Session to receive oral report from counsel re- garding action by the parish government for the purpose of acquiring legal services re- lated to the filing of a civil agreement.
A. A public body may hold an executive session pursuant to R.S. 42:16 for one or more of the following reasons:

(2) Strategy sessions or negotiations with respect to collective bargaining, prospective litigation after formal written de- mand, or litigation when an open meeting would have a detrimental effect on the bargaining or litigating position of the public body.
Mr. Adams mov-ed that Parish President Sam Jones, the Parish Council, Chief Ad- ministrative Officer Paul Governale, former 16th Judicial District Attorney Bernie Boudreaux, and Legal Counsel Morgan Guillory Bodin go into Exe- cutive Session to receive oral report from counsel re- garding action by the parish government for the purpose of acquiring legal services re- lated to the filing of a civil agreement.
Mr. Duhon seconded the motion, which carried.
Following Executive Session, Mr. Adams moved that the May 8, 2024 Regular Meeting be reconvened. Mr. Duhon seconded the motion, which carried.
Mr. Adams re- quested to moved up Item 16A, “Discussion and action, if necessary, on items discussed in Executive Session.”
After discussion, Mr. Olander moved that the following Resolution, as discussed in Executive Session, be adopted. Mr. He- bert seconded the motion, which carried by the following 10-0-0-1 Roll Call vote:

RESOLUTION
Resolution of support to express opposition to the filing of any coastal erosion/coastal permit, coastal zone management, or other similar lawsuits but to urge, request and authorize the District Attorney for the 16th Judicial District to accept the offers of any oil and gas companies requesting the settlement of coastal erosion/coastal permit, coastal zone management, or other similar claims which St. Mary Parish might have against them under the same or similar terms and conditions as such oil and gas companies have reached with other coastal parishes.
WHEREAS, it has been reported that Cameron Parish and the State of Louisiana have settled its coastal erosion/coastal permit disputes with several large oil and gas companies; and
WHEREAS, the parties to that litigation are subject to the terms of a Confidentiality Agreement and related Order that prohibit them from disclosing the terms of that settlement; and
WHEREAS, several of the large oil and gas companies involved in the Cameron Parish coastal erosion/coastal permit litigation have apparently reached agreements to settle such litigation with other coastal parishes and are in the process of memorializing those settlements; and
WHEREAS, the St. Mary Parish Council wish to express its opposition to “any lawsuits” filed by Governor John Bell Edwards, Attorney General Jeff Lan-dry, and the 16th Judicial District Attorney against oil and gas companies for, or on behalf of St. Mary Parish regarding coastal erosion/coastal permits; and
WHEREAS, the District Attorney for the 16th Judicial District has not filed any lawsuit(s) against oil and gas companies for, or on behalf of St. Mary Parish regarding coastal erosion/coastal permits, but as a prudent advisor of St. Mary Parish Government has, whenever possible, continued to monitor any such lawsuits filed by other parishes; and
WHEREAS, despite having not filed any coastal erosion/coastal permit, Coastal Zone Management, or other similar lawsuits against oil and gas companies, the District Attorney for the 16th Judicial District has been ap- proached by several major oil and gas firms seeking to settle any coastal erosion/coastal permit, Coastal Zone Management, or other similar claims against said companies in the same or similar manner as the settlements with other parishes; and
WHEREAS, the failure of St. Mary Parish to accept any such offer to settle any such coastal erosion/coastal permit, Coastal Zone Management, or other similar lawsuits being made by or on behalf of any various oil and gas companies will not prevent such companies from settling those claims with the State of Louisiana resulting in St. Mary Parish being un- able to depend up- on or direct the settlement proceeds to coastal restoration projects in St. Mary Parish.
NOW, THEREFORE, BE IT RESOLVED that the St. Mary Parish Council does hereby express its opposition to the filing of any coastal erosion/coastal permit, Coastal Zone Management, or other similar lawsuits.
BE IT FURTHER RESOLV-ED that the St. Mary Parish Council urges, requests and authorizes the District Attorney for the 16th Judicial District to accept the offers of any oil and gas companies requesting the settlement of coastal erosion/coastal permit, Coastal Zone Management, or other similar claims which Iberia Parish Government might have against them under the same or similar terms and conditions as such oil and gas companies have reached with the other coastal parishes.

Chief Administrative Officer, Paul Governale submitted his report for a two (2) week period ending May 8, 2024.
In response to Mr. Hebert’s inquiry relative to filling the Director of Finance’s vacancy, Mr. Governale stated that the position has been offered to current staff members but no one has expressed interest. He also stated that he has received interest from an existing employee in another department that has an accounting degree. He informed that the vacancy notice will be advertised in both newspapers and anyone that is interested and meets the qualifications can contact the Director of Personnel, Jillian Fisher.
Mr. Adams mov-ed to expand the agenda to approve the Public Hearing Report, April 24, 2024. Dr. Rink seconded the motion, which carried.
Mr. Adams mov-ed that the reading of the Public Hearing Report, April 24, 2024 be dispensed with and that the same be approved. Mr. Hebert seconded the motion, which carried.

ORDINANCE

Ordinance amending and re-enacting Ordinance No. 2351 adopting the 2024 Combined Budgets of Revenues and Expenditures for the Parish of St. Mary, State of Louisiana.

RESOLUTION OF SUPPORT
Resolution supporting a partnership between Secure Cignal and St. Mary Parish Office of Economic Development relative to conducting a broadband connectivity analysis to identify locations that lack adequate internet speed, identify locations for infrastructure improvements/enhancements and utilize data and information to pursue funding via the Louisiana Office of Connectivity’s GUMBO Grant Program and the BEAD Grant Program.
WHEREAS, closing the Digital Divide is vital to the economic prosperity and quality of life for residents in St. Mary Parish, State of Louisiana; and
WHEREAS, St. Mary Parish de- clares that high-speed Internet ac- cess referred to generically as “broadband” and including wireless technologies is essential to the 21st Century in- frastructure in a digital world and global economy; and
WHEREAS, the Parish of St. Mary, State of Louisiana, is compromised of large rural areas throughout the Parish, which currently do not have broadband service, or the service is very limited.
NOW, THEREFORE, BE IT RESOLVED by the Council of the Parish of St. Mary, State of Louisiana, acting as governing authority for the said Parish, that they do hereby support a partnership between Secure Cignal and St. Mary Parish Office of Economic Development relative to conducting a broadband connectivity analysis to identify locations that lack adequate internet speed, identify locations for infrastructure improvements/enhancements, and utilize data and information to pursue funding via the Louisiana Office of Connectivity’s GUMBO Grant Program and the BEAD Grant Program.

In response to several Council Members’ inquiries, Director of Economic Development Evan Boudreaux explained that Secure Cignal looks for areas that do not meet basic internet standards. He expounded on testing procedure, infrastructure, and the GUMBO Grant Funding.
RESOLUTION
A RESOLUTION INDICATING THE INTENTION OF PARISH OF ST. MARY, STATE OF LOUISIANA, TO AP- PROVE REMAINDER OF THE TWO (2) YEAR APPOINTMENT OF PAUL J. GOVERNALE AS A DIRECTOR TO THE BOARD OF THE LOUISIANA LOCAL GOVERNMENT ENVIRONMENTAL FACILITIES AND COMMUNITY DEVELOPMENT AUTH- ORITY (THE “AUTHORITY”) AS PROVIDED BY CHAPTER 10-D OF TITLE 33 OF THE LOUISIANA REVISED STATUTES OF 1950, AS AMENDED.
WHEREAS, Chapter 10-D of Title 33 of the Louisiana Revised Statutes of 1950, as amended, comprised of R.S. 33:4548.1 through 4548.16 is known as the Louisiana Local Government Environmental Facilities and Community Development Authority Act (the “Act”); and
WHEREAS, the Act creates the Louisiana Local Government Environmental Facilities and Community Development Authority (the “Authority”) for the purpose of assisting political subdivisions, as defined in the Act, and other designated entities in acquiring, financing and constructing certain facilities, including en- vironmental, public infrastructure, community and economic development purposes and to otherwise establish programs to aid in the financing of local government and economic development projects; and
WHEREAS, the Parish of St. Mary, State of Louisiana, previously passed a resolution to become a participating political subdivision of the Authority in accordance with the Act; and
NOW, THEREFORE, BE IT RESOLVED, by the governing authority of the St. Mary Parish, State of Louisiana, acting in such capacity:
Section 1. Ap- prove the appointment of Paul J. Governale to serve as a Director of the Authority on be- half of St. Mary Parish.
Section 2. This resolution shall take effect immediately and will expire on April 14, 2025. A certified copy hereof shall be forwarded to the offices of the Authority.

RESOLUTION
A Resolution providing for the approval and authorization for Change Order No. 1 relative to the Harry P. Williams Memorial Airport Segmented Circle Project.
WHEREAS, a certain contract has been entered into between the St. Mary Parish Council and Frisco Industrial Contractors, LLC, 216 Willow Street, Franklin, Louisiana 70538, relative to the Harry P. Williams Memorial Airport Segmented Circle Project.
WHEREAS, the items as shown on Change Order No. 1 will result in a decrease of $2,955.30 in the contract price.
NOW, THEREFORE BE IT RESOLVED, that the St. Mary Parish Council does hereby approve the issuance of Change Order No. 1 covering a decrease of $2,955.30 in the contract price for the Harry P. Williams Memorial Airport Segmented Circle Project.
BE IT FURTHER RESOLV-ED that the President of St. Mary Parish, Sam Jones, be and he is hereby authorized to execute Change Order No. 1 on behalf of the St. Mary Parish Council.

Rev. Mathews informed that a town hall meeting will be held on May 20, 2024 at 6:00 p.m. at the West St. Mary Parish Civic Center and invited the public to attend to discuss issues in the parish.
Dr. Rink inform-ed that Evan Boudreaux can be contacted to place an item on the agenda. She stated that internet concerns will be addressed and that the agenda will be posted on social media.
OLD BUSINESS:
A. Discussion and action, if necessary, on items discussed in Executive Session (Resolution).
This item was discussed earlier.
B. Discussion and action relative to the St. Mary Parish Charter Review Commission. (Mr. Ina)
Clerk of the Council, Lisa Morgan, stated that she contacted previous Charter Committee board members. She in- formed that some were unreachable, some were not in- terested, and some were interested.
Mr. Ina reminded that in 2018 a Charter Review Committee was created. He stated that the committee reviewed the current Charter and submitted recommendations to the Council but no action was ever taken. He ex- pounded on the percentage of minority districts and ex- pounded on his proposal for equal representation.
Rev. Mathews stated that he supports Mr. Ina’s proposal and he ex- pounded on the At-Large District representation as per the Home Rule Charter.
Legal Counsel, Morgan Guillory Bodin clarified that the Council is proposing to create a Home Rule Charter Commission, not a Home Rule Charter Committee.
In response to several Council Members’ inquiries, Rev. Mathews explained that a commission is duly sworn into office by the State of Louisiana and has the authority to place items on the agenda without permission or ap- proval from the Council.
Per Mr. Ina’s inquiry, Mrs. Bo- din stated that the Home Rule Charter Commission’s ordinance should be on the next agenda for introduction.
NEW BUSINESS:
A. We received the following fin- ancial statements:
SMP Consolidated Gravity Drainage District No. 2A and Louisiana Legislative Auditor Statewide Agreed-Upon Procedures – year ended September 30, 2023
B. Joe J. Walker has written to re- sign from the Wards 5 & 8 Joint sewer Commission.
Mr. Walker will be sent a letter thanking him for his service and the vacancy will be advertised.
C. Appointments to the following Boards and Commissions:
St. Mary Parish Water and Sewer Commission No. 5 (Four Corners/Glencoe) – 6 Vacancies

Rev. Mathews moved that Sandra E. Lockett, Merker Broussard, Sr., and Wayne Caesar, Sr. be re- appointed and Roy C. Louviere and Nekesia Bowie be appointed to St. Mary Parish Water and Sewer Commission No. 5. Mr. Ina seconded the motion, which carried.
In response to Mr. Hebert’s inquiry, Rev. Mathews stated that only five were appointed tonight, leaving one (1) vacancy.

The purpose of the Public Hearing was to receive written and/or oral comments relative to the following Ordinance:
Ordinance amending and re-enacting Ordinance No. 2351 adopting the 2024 Combined Budgets of Revenues and Expenditures for the Parish of St. Mary, State of Louisiana.
There were no written or verbal comments received regarding the ordinance.
In response to Rev. Mathews’ in- quiry relative to the amended proposition for the 3/10 % Sales Tax Fund, Chief Administrator Officer Paul Governale ex- plained that there is a savings of $17,000 for grass cutting by allowing the Parish’s maintenance crew to cut grass instead of a contractor. He also explained that there is a $50,000 savings for im- provements to He- bert-Washington Park that were postponed.
There being no further business, Mr. Olander moved for adjournment. Mr. Davis seconded the motion, which carried.

RECREATION DISTRICT NO. 1
PROCEEDINGS OF THE BOARD OF COMMISSIONERS OF ST. MARY PARISH RECREATION DISTRICT NO. 1
The board of Commissioners of St. Mary Recreation District No. 1 met in regular session on Tuesday April 16, 2024.
The meeting was called to order by Mrs. Janice Aucoin at 6:00 pm.
Roll was called and those present were Commissioners Mrs, Carla Gagliano, Manager Michael Beadle, Mr. Tyrone Richardson, Mrs. Janice Aucoin, Mr. Anthony Scully, Mr Steve Patureau
Guests Chuck Walters and Parish Councilman Mark Duhon
A motion was made by Mr. Steve Patureau to accept the minutes as written. The motion received a second from Mr. Anthony Scully. All were in favor.
The monthly bills were review-ed. A motion was made by Mr. Steve Patureau to pay the bills. The motion received a second from Mr. Anthony Scully. All were in favor.
Mr. Mike Beadle presented the treasures report. A motion was made by Mr. Anthony Scully to accept the report as read. The motion receiv-ed a second from Mrs. Carla Gagliano. All were in favor.
Agenda Items Discussed
Mike Beadle presented managers report. Discussion on walking trail proposal was reviewed and presented by Chuck Walters. A motion was made to enter into a governmental agreement with St. Mary parish to produce matching funds for walking trail grant. District #1 agreed to allocate up to $125,000 in funds in support of grant to put toward trail for the community to use as an extension of the recreational center according to the 3/10 statute in place. Mr. Steve Patureau made a motion to approve. Mr. Tyrone Richardson made a second. All other were and favor and no one opposed. Mo- tion passed. Re- view Monthly bills report. All in favor to approve and pay. Discussion was talked about of recent vandalism to ball fields. Discussed changing fencing on 140 ft of chain link fence on Dixie League field. Ap- proved to have repair work done not to exceed $2,100. Intent to call election for new millage rates on May 21, 2024. After all issued were addressed and no further matters were present, Mr. Anthony Scully made a motion to adjourn the meeting. All were in favor.

TAKE NOTICE, that by virtue of Order of Seizure and Sale issued out of the Honorable 16th Judicial District Court, in and for the Parish of St. Mary, and to me directed, in the above numbered and entitled suit, I have seized the following mentioned and described property, to wit:
That certain lot or parcel of land, together with all buildings and im- provements thereon and thereunto belonging and all rights, ways, privileges and servitudes thereunto belonging and all rights, ways, privileges and servitudes thereunto appertaining, lying and being situated in Section 13, T 15 S, R 12 E, Town of Berwick, Parish of St. Mary, State of Louisiana, being more particularly known, designated and des-cribed as Lot Two (2), containing 2.07 acres, more or less, as shown on the plat entitled “Plan of Land Showing Glenwild3 Subdivision Phase II” prepared by Miller Engineers & Associates, Inc., dated March 9, 1998, bearing Drawing No. 9801 and recorded in St. Mary Parish COB 41-M, Entry No. 262,183 to which reference is made for greater particularly as to location, dimensions, boundaries, shape and description of said lot or parcel of land. According to said plan of land described herein said Lot Two (2) has a frontage along the northerly side of Fairview Drive (formerly known as Old Spanish Trail) a distance of One Hundred Fifty and Forty Nine Hundredths (150.49’) feet, with a depth along its easterly boundary line of distance of Six Hundred Eighteen (618’) feet, more or less, to the bank of the Atchafalaya River, with a depth along its westerly boundary line a distance of Six Hundred Thirty Seven (637’) feet, more or less, to the bank of the Atchafalaya River and with a width across the rear along the meandering bank of the Atchafalaya River a distance of One Hundred Forty Nine (149’) feet more or less. According to said plan of land, Lot Two (2) is bounded northerly by the Atchafalaya River, easterly by Lot Three (3) of Glenwild Subdivision Phase II, westerly by Lot One (1) of Glenwild Subdivision Phase II and southerly by Fairview Drive (formerly known as Old Spanish Trail).
Being the same property acquired by William A. Washburn from the Joseph A. Carbonell and/or Leah C. Carbonell Revocable Living Trust by act of Cash Deed recorded September 17, 2012 in St. Mary Parish COB 261, page 126, under Entry No. 314,300.
The hereinabove described property bears the municipal address of 1458 Old Spanish Trail, Berwick, Louisiana 70342 (also known as 1458 Fairview Drive, Berwick, Louisiana 70342).
to satisfy the sum of FIVE HUNDRED FORTY-FOUR THOUSAND SIX HUNDRED SEVENTY-THREE AND 55/100 ($544,673.55) DOLLARS in principal, with accrued interest and late fees through May 1, 2023, expenses advanced of $12,621.19 for property taxes, and interest thereafter at the rate of $123.35 per day until paid, with 25% of said principal and interest as attorney’s fees and all costs of this proceedings as well as all sheriff’s costs and commissions
All successful bidders must have cash, cashier’s check or a verifiable letter of credit in favor of said bidder from a solvent bank, savings and loan association or other such financial institution authorized to do business in the state of Louisiana and full payment must be made on the date of sale. Letter must state that money is available on the date of sale.
I shall expose the same at public sale, for Cash, according to law WITHOUT ap- praisement to the last and highest bidder, at the principal front door of the 1st floor lobby area of the Court House in the Parish of St. Mary, Town of Franklin, Louisiana, on Wednesday, the 12th day of June A.D., 2024, be- tween the legal hours commencing at 10 O’Clock A.M.
