PROCEEDINGS OF THE MAYOR AND COUNCIL OF THE TOWN OF BERWICK, STATE OF LOUISIANA TAKEN AT A REGULAR MEETING HELD ON TUESDAY
August 11, 2026
The Mayor and Council of the Town of Berwick, State of Louisiana, met in regular session at their regular meeting place, the Town Hall, Berwick, Louisiana, Tuesday August 11, 2026, at six (6:00) o’clock p.m.
There were present: Council members Colleen As- kew, Kevin Hebert, Lud Henry, Raymond Price, and James Richard.
Absent: None
Pastor Justin Lee from Tri-City Pentecostal led the prayer.
Councilman James Richard led the Pledge of Allegiance.
The Mayor and Council of the Town of Berwick, State of Louisiana were duly convened as the governing authority of said Town, led by the Honorable Duval Arthur Jr, Mayor, who then stated that the Mayor and Council were ready for the transaction of business.
The minutes of the previous meeting were approved without reading upon motion Lud Henry and seconded by James Richard.
The Treasurer’s report, having been reviewed, was approved without reading upon motion by James Richard and seconded by Colleen Askew.
The Beacon did not shine on anyone this month.
Guest for the August 2026 meeting was Ms. Beverly Domengeaux from St. Mary Parish Council on Aging. Ms. Do- mengeaux stated that the council on aging is doing well at this time.
Police Chief Jonathan Henry presented the police report for July 2026. Chief Henry stated that things have been running smoothly within the department. Officers handled 317 complaints, is- sued 257 citations, and worked 8 accidents. He also noted that the department has hired a school re- source officer (SRO), Officer Payton Dinger. After no further comments, the mayor moved on to the next item on the agenda, Fire re- port.
Fire Chief Jody Acosta presented the fire report for July 2026. Chief Acosta stated that the fire department responded to 16 emergency calls, which included 2 motor vehicle accidents, 6 medical calls, 3 fire alarms, 1 trash fire, 2 gas leaks, 1 road clean up, and 1 mutual aid (Patterson Boat Fire). After no further comments, the mayor moved on to the next item on the agenda, the Public Works re- port.
Public Works Director Rafael Lopez presented the Public Works report for July 2026. Mr. Lopez stated that crews are continuing to install a new gas line on Thorguson Drive while also performing routine maintenance throughout town. They have also been busy mowing the ditches which was unable to be done over the past month due to equipment issues. With no further comments, the mayor moved on to the next agenda item, the consulting engineer’s re- port.
Town Engineer Mr. Reid Miller was not present. The mayor moved on to the next item on the agenda, committee reports.
The Economic Development, and Public Safety Committees had nothing to report.
The Recreational Committee stated that football registration is currently underway and will close on August 30, 2026. Applications can be obtained from Town Hall or on the Town of Berwick’s Facebook page.
The Historical Committee reported that they recently completed 2 new exhibits and are continuing to ar- chive Berwick history.
The Lighthouse Committee reported that they are working on obtaining sponsorships for the festival, along with continuing to plan events.
The Planning and Zoning Committee presented their report for the month of July 2026. There being no questions or comments, the mayor moved on to the next item on the agenda, Public Hearings.
The Public hearing was called to order at 6:15pm.
Item No. 1 under Public Hearings – Ordinance No. 765 – Amend and Supplement Town of Berwick Zoning Article 3 to Add Section 3.06 to Provide for Temporary and Continuous Conditional or Special Use. With no comments from the council and audience, Mayor Arthur closed the public hearing.
Item No. 1 under Ordinances Introduce/Adopt – Adopt Ordinance No. 765 – Amend and Supplement Town of Berwick Zoning Article 3 to Add Section 3.06 to Provide for Temporary and Conditional or Special Use. Upon motion by Lud Henry and seconded by Colleen Askew, the or- dinance was adopted by a unanimous roll call vote. Kevin Hebert and Raymond Price recused themselves from the vote.
Item No. 2 under Ordinances Introduce/Adopt – Introduce Ordinance No. 766 – Amend 2025-26 Consolidated Budget. Up- on motion by Lud Henry and seconded by Colleen Askew, the ordinance was introduced by a unanimous roll call vote.
Item No. 3 under Ordinances Introduce/Adopt – In- troduce Ordinance No. 767 – 2026-27 Consolidated Budget. Upon motion by James Richard and seconded by Raymond Price, the ordinance was introduced by a 4-1 roll call vote. Lud Henry voted against.
Item No. 1 under Resolutions/Proclamations – Resolution No. 12-26 –A Resolution of Conditional Use and Continuous Use permits on for and on behalf of Magna Operating, LLC. After some discussions be- tween the mayor, council, and audience members, and upon motion by Lud Henry and seconded by Colleen Askew, the resolution was ap- proved by a unanimous roll call vote. Kevin Hebert and Raymond Price recused themselves from the vote.
Item No. 2 under Resolutions/Proclamations – Resolution No. 13-26 - A Resolution to authorize the mayor of Berwick to enter into a lease agreement with Magna Operating, LLC which may provide royalty payments to the town of Berwick. Upon motion by James Richard and seconded by Colleen Askew, the resolution was approved by a unanimous roll call vote. Kevin Hebert and Raymond Price recused themselves from the vote.
Item No. 1 under New Business – Approve Louisiana Compliance Questionnaire. Upon motion by Lud Henry and seconded by Colleen Askew, the questionnaire was approved unanimously.
Item No. 2 under New Business – Approve 2026-27 Holiday Schedule. Upon motion by Raymond Price and seconded by Colleen Askew, the holiday schedule was approved by a unanimous roll call vote.
Item No. 3 under New Business – Efremzimbaliast Randle – “Lace them Up” boxing event – September 19, 2026. There was no representation, so the mayor moved to the next item on the agenda.
Item No. 4 under New Business - Valerie Pitts – Small Business Administration - Office of Disaster Recovery – Tropical Storm Arthur. Ms. Pitts stated that there are low-interest physical disaster loans now available for small businesses in connection with Tropical Storm Arthur. Item No. 5 under New Business - Approve Payment for Inv# 289120245-4 to Professional Engineering & Environmental Consultants, Inc. for $22,865.04 – Gas System Replacement. Upon motion by Colleen Askew and seconded by Raymond Price, the payment was approved by a un- animous roll call vote.
Item No. 6 under New Business – BEARS Radio Club – August 14-15, 2026. The BEARS Radio Club would like to hold a weekend event, August 14 through August 15, 2026, at the riverfront pavilion. Upon motion by Colleen Askew and seconded by James Richard, use of the pavilion was approved unanimously.
There being no further business to come before the Council, upon motion by James Richard and seconded by Raymond Price the motion to adjourn was ap- proved unanimously.

PROCEEDINGS OF A REGULAR MEETING
THE BOARD OF COMMISSIONERS OF THE MORGAN CITY HARBOR AND TERMINAL
DISTRICT
July 20, 2026
The Board of Commissioners (“Board”) of the Morgan City Harbor and Terminal District (“District”) met in regular session at the District’s office at 7327 Highway 182, Morgan City, Louisiana on July 20, 2026 at 12:00 p.m. Ben Adams, President, convened the meeting with Commissioners, Deborah Garber, Steven Cornes, Matthew Glover, Adam Mayon, Troy Lombardo, Matthew Tycer, Michael Wise, and Marc Felterman in attendance. Also present in the meeting were Raymond Wade, Executive Director; Simon Gottung, Deputy Director; Cindy Cutrera, Economic Development Manager; Michael Knobloch, Special Projects Manager; Shelley Morell, Administrative Assistant; Gerard Bourgeois and Bill Bourgeois, Board Attorneys; Bill Blanchard, GIS Engineering; St. Mary Parish Councilman Les Rulf; and members of the general public.
The meeting was called to order, and the presence of a quorum was noted. Raymond Wade led the invocation, and the Pledge of Allegiance was recited.
It was moved by Mr. Lombardo and seconded by Mr. Mayon that the minutes of the regular meeting of June 15, 2026 be approved and adopted, with said motion carrying unanimously.
It was moved by Mr. Cornes that the report of receipts and disbursements for the month of June, 2026 be received and accepted and that all invoices presented to the Board for the month of June, 2026 be paid. Mr. Wise seconded that motion, which carried unanimously.
Mr. Adams presented the 2026/2027 budget that had been previously emailed, faxed or otherwise delivered to the Board. It was mov-ed by Mrs. Garber and seconded by Mr. Cornes that the 2026/2027 budget be adopted, the expenditures of the funds therein for 2026/2027 be authorized and the following resolution be adopted, which was unanimously approved.
RESOLUTION
A resolution providing for the adoption of the 2026/2027 budget for the Morgan City Harbor and Terminal District (“District”).
WHEREAS, this Board of Commissioners (“Board”) deems it necessary and proper to prepare and adopt a budget with de- fined goals on revenues and expenses for the fiscal year beginning July 1, 2026 through June 30, 2027;
BE IT RESOLV-ED, that the Morgan City Harbor and Terminal District does hereby approve the budget presented and adopts it as an Operating Budget of Revenues and Expenditures for the fiscal year beginning July 1, 2026, and ending June 30, 2027;
BE IT FURTHER RESOLVED by the Board that the detailed estimate of Revenues and Expenditures for the fiscal year beginning July 1, 2026, and ending June 30, 2027 presented this evening, be and the same is hereby adopted as the Operating Budget for the Morgan City Harbor and Terminal District, during the same period.
BE IT FURTHER RESOLVED by the Board that the detailed estimate of Revenues and Expenditures for the fiscal year beginning July 1, 2026, and ending June 30, 2027 presented this evening, be and the same is hereby declared to operate as an appropriation of the amount therein set forth within the terms of the budget classification.
BE IT FURTHER RESOLVED by the Board that any deviations or budgetary amendments require the approval of the Morgan City Harbor and Terminal District Board.
Michael Knobloch reported that: (i) after Mr. Blum reviewed all bids received for the warehouse re-roofing project, he rejected the apparent low bidder, Bluleaf, for failing to counter sign their bid bond and certified Allison Enterprise as the low bidder. Mr. Mayon moved to certify compliance with public bid law and accept the second lowest bidder, Allison Enterprise in the amount of $280,400, which was seconded by Mr. Wise and carried unanimously.
RESOLUTION CERTIFYING COMPLIANCE WITH THE PUBLIC BID LAWS
Whereas, the Morgan City Harbor and Terminal District (“District”) has solicited bids for its Warehouse Infrastructure Im- provements, Planning and Construction (St. Mary) project, which is identified by Louisiana Facility Planning and Control under Project No. 36-P15-23-02 in accordance with the current bid laws of the state of Louisiana, including, but not limited to R.S. 38:2211 et. seq.; and
NOW, THEREFORE, BE IT RE- SOLVED by the Morgan City Harbor and Terminal District, in Regular session, assembled on this 20th day of July, 2026, do hereby certify that the bidding procedures comply with Louisiana Revised Statutes 38:2211, et. seq.
BE IT FURTHER RESOLVED that Raymond M. Wade, Executive Director be and is hereby authorized and directed to do any and all acts and things on behalf and in the name of the District that he deems necessary, proper, or that may be required in regards to the certification of said bidding.
RESOLUTION FOR AWARD OF PROJECT
WHEREAS, the Morgan City Harbor and Terminal District (“District”) has received bids on July 14, 2026 at 2:00 p.m. for its Warehouse Infrastructure Improvements, Planning and Construction (St. Mary) project, which is identified by Louisiana Facility Planning and Control under Project No. 36-P15-23-02; and
WHEREAS, Carl P. Blum AIA Architect, the District’s architect on this project, has recommended the award of the contract for this project to the lowest qualified bidder: Alison Enterprise LLC.
NOW, THEREFORE, BE IT RESOLVED by the Morgan City Harbor and Terminal District at a Regular Meeting, as- sembled on this 20th day of July, 2026, that the Base Bid in the Amount of $195,400.00 and Alternate 1 in the Amount of $85,000.00 by Alison Enterprise LLC be accepted, a contract be awarded to Alison Enterprise LLC. and the District provide all appropriate funding needed to award the base bid and any change orders for said Warehouse Infrastructure Improvements, Planning and Construction (St. Mary) project.
BE IT FURTHER RESOLVED that Raymond M. Wade, Executive Director be and is hereby authorized and directed to do any and all acts and things on behalf and in the name of the District that he deems necessary, proper, or that may be required in regards for the award and execution of said contract and approval of any or all alternates and any related change order.
(ii) we will be submitting five (5) projects within our FY26 Port Security Grant program application, in- cluding a possible drone project. But, recently he was made aware of another grant that could absorb the drone portion to be used to monitor our waterways, Bayou Chene structure and possibly in partnership with local law enforcement agencies that has a zero match obligation; (iii) our forklift should be delivered the first week of August, which is the final piece of equipment for the FY23 US Marine Highways grant and the MARAD agreement for FY25 US Marine Highways grant has been executed by Mr. Wade and submitted to Washington for their approval.
Robert Karam reported the West dock project is currently being rebid, with a pre-bid meeting on August 3rd and bid opening on August 13th. He hopes to have the certified bid tabulation prepared for adoption at the August 17th board meeting.
Bill Blanchard reported that a minor correction was needed on the access channel plans and were re- submitted to FP&C for their final approval. Mr. Bourgeois noted that the plans were also changed to reflect public bid law requirements, so Mr. Glover moved to authorize advertisement for bids, contingent upon FP&C approval, which was seconded by Mr. Cornes and carried unanimously.
Cindy Cutrera reported: (i) this morning we participated in both a Navigation Restoration call with the Corps and a National Weather Service call in anticipation of upcoming weather; (ii) the Mississippi River Commission will hold their annual public low water meeting on August 21st at our dock and we are also working on an industry boat tour for the MRC commissioners; (iii) the DOTD, Multi-Modal Commerce folks came down for an industry boat tour and were amazed by the amount of industry in our area, as well as our new crane; (iv) she has posted a series on LinkedIn called “where can you go from here” over last few weeks and the most popular post was about the Saronic Marauder Medium Unmanned Surface Vessel (MUSV) performing sea trials at our dock; and (v) Mac was invited to attend the Summit at Sealevl with the Secretary of the Army, CPRA, and Corps to discuss “build infrastructure not paperwork” initiative.
Simon Gottung reported: (i) we had six (6) critical lifts for Weeks Marine and a series of lifts for the Katrina Fagan in preparation for their Coast Guard certification; (ii) we hit the 6- month/50 hours maintenance mark on the crane; (iii) we provided Saronic access to this building as well as the dock facilities during their sea trials; and (iv) we’ve completed several maintenance items during the month including carpets clean-ed, steaming of tiles, pressure washing, and painting of parking lot and dock in anticipation of both CPRA and MRC visits to our facilities. Mr. Wade encouraged everyone to attend the CPRA meeting since it is being held at our facility and Mr. Dove insisted we host a meeting in Morgan City.
Tim Connell re- ported that: (i) Dredge Arulaq continues dredging the Bar Channel but will be going in shipyard in August and the Dredge Newport will come in to keep things stirred up. Mr. Wade not-ed Newport is the dredge that was used during the VE study that proved agitation will work. (ii) Dredge Captain Frank will finish up mid-August cleaning up small stuff by Mile 150 in Bar Channel; (iii) they will be awarding a contract in September to be in queue for next year but if needed before then, they can is- sue a notice to proceed. Mr. Wade gave kudos to Tim and the Corps for getting Berwick Harbor in fantastic shape for a stakeholder’s upcoming sail out.
Gerard Bourgeois presented: (i) audit engagement letters from Darnall Sikes & Frederick for control and compliance areas identified in the LLA’s Statewide Agreed-Upon Procedures (SAUPs) and financial audits, which include a single audit due to federal funds re- quirements. Mrs. Garber moved to authorize execution of said engagements, which was seconded by Mr. Lombardo and carried unanimously; and (ii) a contract between the District and Bourgeois Law, LLC for attorney services, which Mrs. Garber moved, Mr. Cornes seconded and motion carried unanimously to authorize Mr. Adams to execute said contract.
RESOLUTION
A Resolution providing for the execution of contract with a law firm for the Morgan City Harbor and Terminal District, designating the terms and conditions of the contract, and granting the authorization therefor.
WHEREAS, this Board of Commissioners is authorized by the provisions of LSA-R.S.34:324 to “contract with and em- ploy attorneys, clerks, engineers, deputy commissioners, superintendents, stevedores and other agents and em- ployees and shall fix their compensation and terms of office or employment,” and,
WHEREAS, this Board of Commissioners, after due deliberation deems it necessary to protect the public interest, and that real and genuine necessity exist therefor, to contract for legal services and for Bourgeois Law, LLC. to act as General Counsel in connection with the handling of various legal matters that may affect the District.
BE IT RESOLV-ED, that the President, Ben A. Adams, is hereby authorized and directed to execute on behalf of the Morgan City Harbor and Terminal District an attorney agreement with Bourgeois Law, LLC, for the necessary legal services relative to Morgan City Harbor and Terminal District, substantially in accordance with the terms and conditions of the attorney agreement presented this day.
After the Motion of Mr. Cornes, second of Mr. Tycer and unanimous roll call, the Board entered Executive Session to discuss its suit against Providence Engineering & Environmental Group, LLC and Patriot Construction and Industrial, LLC for Youngswood yard failure. After the Executive Session ended, it was un- animously agreed that the Board return to Regular Session.
With there being no further business to come before the Board, it was moved by Mr. Wise and seconded by Mr. Mayon that the meeting was adjourned.

The St. Mary Parish Council met on this date in Special Session with Chairperson Gwendolyn L. Hidalgo presiding and the following members present: Rev. Craig Mat-hews, J Ina, Rodney Olander, David W. Hill, Patrick Hebert, James “Jimmy” Davis, Jr., Mark Duhon, Dean Adams, and Kristi Prejeant Rink, M.D. Absent was Leslie Rulf, Jr.
The Invocation was pronounced by Dr. Rink and the Pledge of Allegiance was led by Mr. Adams.
Dr. Rink moved that the reading of the First Regular Meeting, July 8, 2026 be dispensed with and that the same be approved. Mr. Davis seconded the motion, which carried.
Mrs. Hidalgo acknowledged Mayor Clarence Vappie, Town of Baldwin, in attendance.
Valerie Pitts, U. S. Small Business Administration representative, appeared before the Council to discuss disaster aid available to St. Mary Parish residents following Tropical Storm Arthur.
Tomika Willis, owner of TDS Trucking & Training Technology and TDS Drone Innervation Services, appeared be- fore the Council to discuss leasing property at 4418 Helicopter Road, Patterson. She stated that she had previously received a letter of intent from the former Chief Ad- ministrative Officer a few years ago but has since been informed that the property is now under contract with another company. Mrs. Willis explained that because she was born and raised in St. Mary Parish, she is committed to bringing economic opportunities to the parish. She also stated there needs to be better communication regarding the lease process. Mr. Ina apologized for any confusion re- garding the letter of intent.
Chief Administrative Officer, Paul J. Governale stated that, his understanding is that the letter of intent was requested by Mrs. Willis to support grant funding. He stated that the lease agreement was never drafted and explained the re- quired application process for leasing aviation property. He noted that Mrs. Willis has been working with Economic Development Director, Evan Boudreaux, to locate other available properties that may meet her needs. Mr. Governale also stated that the Federal Aviation Administration (FAA) is still requesting information that is being submitted and if negotiations with the other company are un- successful, the Parish could enter negotiations with Mrs. Willis regarding this property but will still have to follow FAA regulations.
In response to Rev. Mathews’ in- quiry, Mr. Boudreaux explained the application and approval process for leasing property.
Michael McAdams appeared be- fore the Council to discuss the maintenance at the Senior Center Building in Morgan City. Mr. Mc- Adams stated that he is an AARP member and has been managing that room for several years. He ex- pressed concern regarding the building’s deterioration, creating potential safety risks for those who use the facility.
Several Council Members discussed the importance of repairing the roof before proceeding with interior repairs to the building.
Trace Barnett, The Towers, LLC representative, ap- peared before the Council to discuss the specific use request to allow for a communications tower at 694 Pan Am Road in Charenton. He ex- plained that The Towers LLC/Integrisite, Inc., is proposing to construct a 255 foot monopole tower with a 10 foot lightening rod for a total of 265 feet, along with the base station equipment located within an 80 x 80 leased area. He further stated that Verizon Wireless will be the service provider for the tower and will offer three (3) additional carriers to connect. He explained that the tower has been registered with the Federal Communications Commission (FCC) and that all equipment will be operated in compliance with FCC regulations and radio frequency initium standards. He noted that the Federal Aviation Administration (FAA) has determined that the tower will not cause a hazard to air navigation.
Mr. Adams re- quested to move up Item 13C, “FOR ADOPTION - An Ordinance in compliance with Ordinance No. 1973, DIVISION 5.4 General Procedures for Public Hearings, Section 5.4.3 Specific Use Permits granting a Specific Use. (The Towers LLC/Integrisite Inc.)”

Parish President, Sam Jones commended Chairperson, Gwendolyn Hidalgo for cancelling last week’s regularly scheduled council meeting due to anticipated weather conditions associated with Tropical Storm Bertha.
President Jones expounded on the Parish’s finances and proposed a solution to limit the amount of funds borrowed.
Discussion was had relative to creating a dedicated road crew regarding road maintenance, personnel shortage, employee work ethic, outstanding debt in relation to its annual income, status of Duhon Boulevard contract with DOTD, impact of unfunded mandates, proper use of funds, and previous administration’s decisions that were made in the best interest of the parish based on available resources at that time.
Chief Administrative Officer, Paul J. Governale, submitted his re- port for a two (2) week period, ending July 22, 2026. He also submitted Departmental Quarterly Reports for Departments of Economic Development, Finance, Homeland Security, Personnel, Planning & Zoning, and Public Works. He also submitted a report from Tim Matte, St. Mary Parish Levee District Director, on the status of TE-168, Pump Station No. 4, Pump Station No. 9, Pump Station No. 8, and Pump Station No. 6 and the Public Fire Protection Survey for Fire District No. 3.
Mr. Governale reported that the Leap Frog study is currently reviewing more than 40 job descriptions for the purpose of ex- panding the Regional Compensation and Information Program (RCIP) survey to include additional job descriptions. He also provided updates on the preparation of next year’s Capital Outlay applications, reported that re- pairs are complete at the Sales Tax & Use Office Building being used by Council on Aging in Morgan City, discussed improving the ongoing grass cutting maintenance and operations, addressed the cost of purchasing a grass cutting tractor, road maintenance complaints, dumpster related complaints and grass cutting at boat launches, and possibly selling the Parish’s asphalt zipper.
Rev. Mathews moved that the Public Hearing Report, July 8, 2026 be approved. Dr. Rink seconded the motion, which carried.
Mr. Hill an- nounced that Chick-Fil-A will be offering a limited menu for purchase on August 5, 2026, from 11:00 a.m. to 2:00 p.m. at 1557 Highway 90 in Bayou Vista (Southland Arms).

Mathews reported on the annual NACo Conference in New Orleans that he recently attended and expounded on the Community Economic and Workforce Development Policy Steering Committee presentation regarding opportunity zones and also expounded on the Health Policy Steering Committee presentation. He suggested the Parish submit an application to Governor Jeff Landry’s office regarding involvement in community economic and workforce development policy.
Mr. Governale informed that St. Mary Parish participated in the 2026 NACo Annual Conference and Exposition in New Orleans. He commended Clerk of the Council, Lisa Morgan, Finance Director, Desiree Gros, and Executive Director of Cajun Coast Visitors & Convention Bureau, Carrie Stansbury for their leadership and efforts in coordinating and representing St. Mary Parish at the NACo Closing Reception.

WHEREAS, after duly advertising in the Morgan City Review, Bids were received on March 26, 2026, for the New Central Fire Station for St. Mary Parish Fire District 11. The apparent low bidder was Del-Con LLC of Morgan City and Gonzales LA, with a Base Bid of $2,230,800, and
WHEREAS, the bid from Del-Con LLC is also the lowest bid will all three deductive alternatives considered. The Alternates include De- duct Alternate #1 of $11,643 for Deletion of Limestone Service Drive to Rear, De- duct Alternate #2 of $76,200 for De- lete Automatic Generator, and De- duct Alternate #3 of $28,085 for De- letion of Metal Wall Panels in Engine Room & Front Brick work and Plaster Work. The difference in the bid after the $115,928 amount of the Deductive alternates is subtracted is $2,114,872, and
WHEREAS, the St. Mary Parish Government hereby commits to a local match of 25% of the total project cost and any cost overrun pertaining to this project, and

Resolution re- pealing the temporary moratorium on the development, establishment, construction, and expansion of utility-scale solar energy facilities in the unincorporated areas of St. Mary Parish, Louisiana.
WHEREAS, on December 10, 2025, the St. Mary Parish Council adopted a Resolution establishing a temporary twelve (12) month moratorium on the de- velopment, establishment, construction, and ex- pansion of utility-scale solar energy facilities in the unincorporated areas of St. Mary Parish; and
WHEREAS, the purpose of the temporary moratorium was to provide the Council sufficient time to study utility-scale solar de- velopment, evaluate potential im- pacts upon agriculture, residential property, drainage, public infrastructure, and the general welfare, and to consider appropriate regulations governing such development; and
WHEREAS, since adoption of the temporary moratorium, the State of Louisiana has enacted legislation establishing a statewide regulatory framework for utility-scale solar energy facilities, including permitting requirements and minimum siting standards; and
WHEREAS, the Council recognizes that state law and applicable parish regulations provide a framework through which proposed solar developments may be reviewed on their individual merits while protecting the health, safety, and welfare of the citizens of St. Mary Parish; and
WHEREAS, the Council further finds that continuation of the temporary moratorium is no longer necessary to accomplish the purpose for which it was enacted and that allowing applications to proceed under applicable law will promote consistency, fairness, and orderly economic development within the Parish; and
WHEREAS, nothing contained herein shall be construed to waive compliance with any applicable parish ordinance, zoning regulation, drainage requirement, state permit, federal permit, or environmental regulation.
NOW, THEREFORE, BE IT RE- SOLVED by the St. Mary Parish Council, acting as the governing authority of the Parish of St. Mary, State of Louisiana, that:
SECTION 1. The Resolution adopted on December 10, 2025, establishing a temporary moratorium on the development, establishment, construction, and expansion of utility-scale solar energy facilities in the unincorporated areas of St. Mary Parish is hereby repealed in its entirety.
SECTION 2. Effective immediately upon adoption of this Resolution, the temporary moratorium is terminated, and the St. Mary Parish Planning and Zoning Department, together with all other appropriate Parish departments, is authorized to receive, review, and process applications for utility-scale solar energy facilities in accordance with all applicable parish ordinances and state and federal law.
SECTION 3. Nothing in this Resolution shall be interpreted as approval of any particular project. Each application shall be reviewed independently and shall be required to satisfy all applicable legal requirements before any permit or approval is granted.
SECTION 4. The Clerk of the Council is directed to transmit certified copies of this Resolution to the Parish President, the Director of Planning and Zoning, the Parish Attorney, and all other departments responsible for implementation.
BE IT FURTHER RESOLV-ED that this Resolution shall become effective immediately upon its adoption.

Resolution opting out of State Level Regulation of Solar Power Generation Facilities under ACT No. 279 of the 2025 regular session of the Louisiana Legislature.
WHEREAS, Act No. 279 of the 2025 Regular Session of the Louisiana Legislature enacted provisions governing the siting and permitting of solar power generation facilities, codified in Louisiana Re- vised Statutes 30:1131 through 30:1145; and
WHEREAS, Louisiana Revised Statute 30:1142(B) authorizes any parish that has adopted solar ordinances to opt out of the state-law siting requirements by resolution; and
WHEREAS, the St. Mary Parish Council has determined that local regulation is in the best interest of the citizens of St. Mary Parish and that local officials are best positioned to evaluate land use, environmental conditions, agricultural impacts, drainage, infrastructure, and community compatibility associated with proposed solar power generation facilities; and
WHEREAS, the St. Mary Parish Council desires to retain local authority over the siting, regulation, and permitting of solar power generation facilities within St. Mary Parish pursuant to its existing and future ordinances.
NOW, THEREFORE, BE IT RE- SOLVED by the St. Mary Parish Council, State of Louisiana, acting as the governing authority of St. Mary Parish, that:
Section 1. Pursuant to Louisiana Revised Statute 30:1142(B), St. Mary Parish hereby elects to opt out of the state-law siting requirements established by Act No. 279 of the 2025 Regular Session of the Louisiana Legislature.
Section 2. The siting, regulation, and permitting of solar power generation facilities within St. Mary Parish shall continue to be governed by the ordinances duly adopted by the St. Mary Parish Council, as they may be amended from time to time.
Section 3. The Parish President and the Clerk of the Council are authorized and directed to transmit a certified copy of this Resolution to the Louisiana Department of Energy and Natural Resources, or its successor agency, in accordance with Louisiana law.
Section 4. This Resolution shall become effective immediately upon its adoption.

WHEREAS, the Board of Commissioners of Recreation District No. 4 of the Parish of St. Mary, State of Louisiana (the “Governing Authority”), acting as the governing authority of Recreation District No. 4 of the Parish of St. Mary, State of Louisiana (the “District”), adopted a resolution on July 15, 2026, calling a special election in the District on Saturday, De- cember 12, 2026, to authorize the levy of a special tax therein; and
WHEREAS, the Governing Authority has requested that this Parish Council, acting as the governing authority of the Parish of St. Mary, State of Louisiana, give its consent and authority for the District to hold the aforesaid election, and in the event that the election carries to levy and collect the special tax provided for therein; and
WHEREAS, as required by Article VI, Section 15 of the Constitution of the State of Louisiana of 1974, it is now the desire of this Parish Council to approve the holding of said election and in the event that the election carries, to authorize the District to levy and collect the special tax provided for therein;

In response to Mr. Ina’s inquiry relative to the em- ployee’s certification status, Mr. Governale stated that the Parish is currently utilizing a third party certified individual to oversee the in house mosquito control program. He further stated that the employee who had been pursuing certification is no longer interested in obtaining it. He also inform-ed that a different mosquito control employee is seeking employment elsewhere.
Discussion followed regarding the monitoring of mosquito schedules, mosquito issues and populations, and cost associated with aerial mosquito spraying.
C. Bonita Peltier has written with regret that I will be resigning as a board member for Recreation District No. 7 effective on July 15, 2026.
Mrs. Peltier will be sent a letter thanking her for her service and the vacancy will be advertised.
Mr. Olander in- formed that Mrs. Peltier is resigning from her current position in order to serve as secretary for Recreation District No. 7.

Mr. Hicks made a motion to accept the minutes from the July regular meeting, second by Ms. Dural. All were in favor. Motion carried.
The July treasurer’s reports for the Amelia and Morgan City/Siracusaville areas were presented. Mr. Hicks made a motion to approve the treasurer’s reports, second by Ms. Dural. All were in favor, motion carried.
New Business: Election of officers was held. Ms. Dural nominated Mr. Hicks as secretary/treasurer, seconded by Mr. Boykin. All were in favor, motion carried. Mr. Hicks nominated Mr. Patureau as chairman, seconded by Ms. Dural. All were in favor, mo- tion carried. Mr. Patureau nominated Mr. Boykin as vice-chairman, seconded by Mr. Hicks. All were in favor, motion carried. Mr. Hicks addressed the board regarding the budget that will need to be adopted next month. Mr. Pa- tureau discussed the proposal for cameras at the pump stations. Mr. Rappmundt addressed the board regarding the process for invoice approval and payment. Ms. Dural addressed the board about ditch cleaning in the Siracusaville area. There was discussion about cleaning out/ digging out station 4 drainage canal to LA 70, no action was taken.
Old Business: A motion was made by Mr. Hicks to allow the expenditure of up to $10,000 to replace engine controls with Murphy control panel, seconded by Mr. Rappmundt. All were in favor, motion carried. There was discussion about the clean-up that needs to be done at station 6. There was discussion about the station 4 electric pump failure and fuel issues. There was discussion about culvert reutilization in feeder ditch be- tween Cypress Gardens and Marquis Manor. Mr Hicks made a motion to table this, seconded by Mr. Boykin. All were in favor, mo- tion carried. Mr. Patureau handed out a proposed Walnut Canal Operations Plan. Mr. Boykin made a motion to table the adoption, seconded by Mr. Hicks. All were in favor, motion carried. There was discussion about cutting the trees on Fir St. A motion to allow the expenditure of $20,000 to move a pump to the Amelia Rec. Center was made by Mr. Boykin, seconded by Mr. Hicks. All were in favor, motion carried. An update was given on the progress of the Amelia generators project. A motion to table the Emerson SCADA improvements was made by Mr. Hicks, seconded by Mr. Boykin. All were in favor, motion carried. A motion to allow Mr. Sid Moffett to take care of the station 7 issues was made by Mr. Hicks, seconded by Mr. Patureau. All were in favor, motion carried.
Mr. Moffett gave his station reports.
Motion to Ad- journ was made by Ms. Dural, second by Mr. Boykin. All were in favor. Motion carried. The meeting ended at 7:44 pm
