Notice is hereby given that the following proposed ordinance has been submitted at a regular meeting of the City Council of the City of Patterson, Louisiana on the 6th day of August 2024.
INTRODUCTION OF
ORDINANCE NO. 2024-08A
AN ORDINANCE TO AUTHORIZE THE CITY TO ENTER INTO A COOPERATIVE ENDEAVOR AGREEMENT FOR THE SALE OF GAS TO BERWICK, RATE AND OTHER TERMS AND CONDITIONS
WHEREAS, Patterson and Berwick each currently own and operate a natural gas distribution system (the “Gas Systems”) contiguous to each other in the State of Louisiana as revenue-producing public utilities pursuant to Chapter 10 of Title 33 of the Louisiana Re- vised Statutes (the “Act”); and
WHEREAS, Berwick wishes to acquire gas from Patterson on an emergency basis, and Patterson wishes to supply gas to Berwick on an emergency basis; and
WHEREAS, in order for Patterson to supply gas to Berwick the Gas Systems of the Participating Authorities need to be interconnected; and
WHEREAS, the Act authorizes any political subdivision of the State of Louisiana (the “State”), including the parties, to construct, acquire, extend, or improve any revenue-producing public utility and property necessary thereto, either within or without its boundaries, and operate and maintain said utility in the interest of the public; and
WHEREAS, State law permits political subdivisions such as the parties to engage jointly in the construction, acquisition or improvement of any public project or improvement, the promotion and maintenance of any un- dertaking or the exercise of any power, provided at least one of the participants is authorized under a provision of general or special law to perform such activity or exercise such power as may be necessary for completion of the undertaking; and
WHEREAS, such arrangements may provide for the joint use of funds, facilities, personnel or property or any combination thereof necessary to accomplish the purposes of the agreement, and such agreements may include but are not limited to activities concerning health protection, public utility services and the construction or acquisition or improvement, and operation, repair and maintenance of public projects or improvements; and
WHEREAS, each of the parties has the power to operate, maintain, improve, extend, or dispose of gas distribution facilities; and
WHEREAS, the parties desire to set out the terms of their cooperation regarding the interconnection of their Gas Systems and the sale of gas by Patterson to Berwick,; and
WHEREAS, during the term of this Agreement, each of the parties will mutually benefit from the interconnection of the Gas Systems and from the sale of gas by Patterson to Berwick, and each of the parties expressly reserves the right in the future to seek services independent of each other; and
WHEREAS, any further interconnection of gas distribution services in the future, other than those ex- pressly set forth herein, will be subject to a vote of and approval of the Mayor and City Council of Patterson and the Mayor and Town Council of Berwick.
WHEREFORE, BE IT ORDAINED by the Mayor and Council of the City of Patterson, Louisiana, that:
Section 1:
The Mayor shall be authorized to enter into a Cooperative Endeavor Agreement on behalf of the City of Patterson with the Town of Berwick providing for the sale of gas by Patterson to Berwick in the general form and substance as that provided in the Cooperative Endeavor Agreement, a copy of which is at- tached as Exhibit “A”.
Section 2:
RODNEY GROGAN, Mayor, be and is hereby authorized and directed to execute all instruments necessary and proper to carry out the purpose of this ordinance, including all terms and conditions which he deems advisable in his sole discretion.
The foregoing Ordinance was introduced Councilmember Ray Dewey at the regular monthly meeting of the City Council held on August 6, 2024, and notice of which was published in the official journal of the City on August 9th, August 16th and August 23rd, and was offered by Councilmember Mamie Perry who moved its adoption, seconded by Councilman ———————, at the regular monthly meeting of the City Council on ———————, and being read and considered section by section, the Ordinance was submitted to vote with the results as follows:

The St. Mary Parish Home Rule Charter Revision Commission met on this date with the following members present: Dr. Gary Wiltz, John Higdon, Jeremy Chesteen, Norbert Wanous, Betty Hicks, Kenneth Perry, Jr., and Barry Dufrene. Ab- sent were Mayor Clarence Vappie, John Armato, and John Trevino, Sr.
The meeting was called to order by Parish President Sam Jones. Also present were Legal Counsels Eric Duplantis and Morgan Guillory Bodin, Clerk of the Council Lisa Morgan, Assistant Clerk of the Council Roshonda Bourgeois, Chief Administrative Officer Paul Governale, Council Members Rev. Craig Mathews, Leslie Rulf, Jr., James “Jimmy” Davis, Jr., Mark Duhon, Dean Adams, Kristi Prejeant Rink, M.D., and Gwendolyn Hidalgo.
The Invocation was pronounced by Eric Duplantis and the Pledge of Allegiance was led by President Jones.
Legal Counsel, Eric Duplantis and Morgan Guillory Bodin, Assistant District Attorney’s explained that the District Attorney’s Office provides legal advice to the Parish Council and any board or commission, unless another attorney is hired. He stated that the Home Rule Charter was written in 1984 and that changes will be submitted to the Council who will propose these changes to the voters.
Mr. Duplantis conducted training relative to having meetings in open format to the public, open meeting laws, public records requests, creating and posting agendas and minutes. He also informed that the agenda has to be posted at least 24 hours before the meeting, only agenda items can be discussed at that meeting, and the Chairperson conducts each meeting.
Legal Counsel, Morgan Guillory Bodin stated that the Commission has been given informative material and that she and Mr. Duplantis are here to help and provide guidance to them.
Mr. Duplantis informed that since there are only seven (7) Commission Members present, a Temporary Chairperson can be appointed tonight.
Rev. Craig Mathews, District No. 1 Councilperson expressed sincere gratitude to the Commission and their willingness to serve St. Mary Parish. He expounded on the importance of moving the Parish forward for the future. He stated that the Parish Council has no authority over any decisions that the Commission has relating to revisions of the Charter.
Mr. Duplantis also informed that every agenda will have Public Comment to give the public the opportunity to speak. He suggested that the Commission take the opinions of the Parish Council and the public into consideration to help them with this process.
Gwendolyn Hi- dalgo, At-Large District No. 10 Councilperson thanked the Commission for serving and informed that they can reach out to Legal Counsel and Parish Council Members with any questions or concerns.
Kristi Prejeant Rink, M.D., At- Large District No. 9 Councilperson thanked the Commission for serving and stated that the presentation to citizens is important and revisions of the Home Rule Charter needs to govern the Parish for a long time. She stated that she can be contacted with any questions or concerns.
In response to Mr. Dufrene’s in- quiry relative to the Town Hall Meetings, Rev. Mathews explained that the first one was held recently at the West St. Mary Civic Center and that Economic Development Di- rector, Evan Boudreaux will inform of the date, time, and place of the next Town Hall Meeting.
Dr. Rink stated that the next Town Hall Meeting is scheduled to be held in Franklin but there are issues with a location.
President Jones stated that he would like to see the St. Mary Parish President have the same authority as neighboring Parish Presidents and Mayors of municipalities, i.e. when the Parish President takes office, he has authority to ap- point a Chief Ad- ministrative Officer and the process does not have to go through 11 Council Members. Secondly, he stated that he would like to have representation for the roads department, parks and recreation department, etc. He asked that the Commission consider equity and representation when making a decision and that the application/qualification process to Boards and Commissions be elevated.
Dr. Wiltz opened nominations for a Temporary Chairperson of the St. Mary Parish Charter Revision Commission for the year 2024. Mr. Dufrene seconded the motion, which carried.
Mr. Dufrene moved that Jeremy Chesteen be nominated as Temporary Chairperson of the St. Mary Parish Charter Revision Commission for the year 2024.
Mr. Wanous moved that Betty Hicks be nominated as Temporary Chairperson of the St. Mary Parish Charter Revision Commission for the year 2024.
Voting to elect Betty Hicks for Temporary Chairperson of the St. Mary Parish Charter Revision Commission were Dr. Wiltz, Mr. Higdon, Mr. Chesteen, Mr. Wanous, Mrs. Hicks, Mr. Perry, and Mr. Dufrene. Absent were Mayor Vappie, Mr. Armato, and Mr. Trevino.
Mrs. Hicks was elected Temporary Chairperson of the St. Mary Parish Charter Revision Commission by a 7-0-0-3 Roll Call Vote.
NEW BUSINESS:
A. Establishment of meeting date, time, place, and deadline for agendas.
After lengthy discussion, Mr. Perry moved that the next meeting be held on Thursday, August 15, 2024 at 6:00 p.m. in the St. Mary Parish Council Chambers, 5th Floor Courthouse, Franklin, Louisiana. Dr. Wiltz seconded the motion, which carried.
B. Adoption of Roberts Rules of Order.
Dr. Wiltz moved that the St. Mary Parish Charter Revision Commission adopt the Roberts Rules of Order. Mr. Perry seconded the motion, which carried.
Mr. Duplantis explained the importance of adopting Roberts Rules of Order.
Dr. Wiltz re- quested that a copy be sent to each Commission Member.
C. Review of St. Mary Parish Home Rule Charter.
In response to Dr. Wiltz’s inquiry relative to obtaining a copy of the minutes from the previous Home Rule Charter Committee, Mr. Ches-teen stated that he was a member on that Committee and that they only met a few times. He stated that there were no formal meetings, discussions were broad, and that they identified certain items of the Charter that were recommended to the Council.
Mr. Duplantis suggested that the Commission read the current Home Rule Charter along with copies of Iberia Parish and Lafourche Parish’s Charter to get an idea of where to start and what to discuss at the August 15, 2024 meeting.
Several Commission Members thanked the Parish Council for trusting and appointing them.
There being no further business, Dr. Wiltz moved for adjournment. Mr. Perry seconded the motion, which carried.

Proposed
Activity in a 100-Year/500-Year Floodplain and/or Wetland
Town of Berwick 2023 LCDBG Street Improvements Program
To: All interested Agencies, Groups and Individuals
This is to give notice that the Town of Berwick has determined that the following proposed action under the 2023 LCDBG Street Improvements Program is located in or near the 100-year/500-year floodplain and/or wetland, and the Town of Berwick will be identifying and evaluating practicable alternatives to locating the action in the floodplain and/or wetland and the potential impacts on the floodplain and/or wetland from the proposed action, as required by Executive Order 11988 and/or 11990, in accordance with HUD regulations at 24 CFR 55.20 Subpart C Procedures for Making Determinations on Floodplain Management and Protection of Wetlands.
The Town of Berwick has been awarded a Community Development Block Grant in the amount of $787,095 from the Louisiana Division of Administration. Grant funds will be used to address conditions of substandard streets in the Sixth Street area of the Town of Berwick. The portion of the street included in the project covers ap- proximately 1,695 linear feet. It is in place however; there is currently no roadway surfacing. Limestone is the existing surface. The improvements consist of scarifying and compacting roadbed to include lime and soil cement treatment, installation of asphaltic concrete levelling course and wearing course, installation of aggregate shoulder material, pavement striping, road signs, etc. The street will be reconstructed and will be retained by the Town for the same use.
Coordinates of the center point of Sixth Street project area is approximately latitude 29.686157, longitude -91.224837 in the Town of Berwick, St Mary Parish, Louisiana. Maps of the project area are available for review at the Berwick Town Hall.
There are three primary purposes for this notice. First, people who may be affected by activities in a floodplain and/or wetland area and those who have an interest in the protection of the natural environment should be given an opportunity to ex- press their concerns and provide information about these areas. Commenters are en- couraged to offer alternative sites outside of the floodplain and/or wetland area, alternative methods to serve the same project purpose, and methods to minimize and mitigate impacts. Second, an adequate public notice program can be an important public educational tool. The dissemination of information and request for public comment about floodplain and/or wetland areas can facilitate and en- hance Federal efforts to reduce the risks and im- pacts associated with the occupancy and modification of these special areas. Third, as a matter of fairness, when the Federal government determines it will participate in actions taking place in floodplain and/or wetland area, it must in- form those who may be put at greater or continued risk.
